This website is operated by Cooper’s Coffee, Eatery & Market (“we,” “us,” “our”). We operate both a physical location in Missouri and an online store selling food, beverages, farm products, and merchandise. We also ship select products nationwide. These Terms of Service (“Terms”) govern your use of our website, purchase of products in-store or online, and any services we provide.

 

By visiting our site, purchasing from us in person or online, or engaging with our services, you agree to these Terms, including any additional policies referenced herein and available by hyperlink. These Terms apply to all customers, visitors, vendors, partners, and content contributors.

 

If you do not agree to all of these Terms, you may not access our site, make purchases, or use our services.

 

We reserve the right to update these Terms at any time by posting changes on our website. Your continued use of the website or our services after changes are posted constitutes acceptance of those changes.

 

Our website is hosted on Wix.com, which provides the platform that allows us to sell our products and services online.


 

 

SECTION 1 – IN-PERSON & ONLINE SALES TERMS

 

By purchasing from us—either in person or online—you confirm that you are at least the age of majority in your state or province of residence, or have parental/guardian consent to purchase.

 

You may not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including, but not limited to, health codes, export laws, or copyright laws).

 

We reserve the right to refuse service or cancel orders at our discretion for any reason, including suspected fraud, payment issues, or misuse of our products or services.


 

 

SECTION 2 – FOOD & PRODUCT SAFETY DISCLAIMER

 

Our products may contain allergens such as dairy, nuts, gluten, soy, or other ingredients. It is the customer’s responsibility to review ingredient lists and allergen statements before purchase or consumption.

 

We are not liable for allergic reactions, illnesses, or injuries caused by consumption or misuse of our products, whether purchased in-store or online. All perishable items should be stored, handled, and consumed according to the instructions provided.


 

 

SECTION 3 – NO GUARANTEE OF AVAILABILITY

 

We make every effort to keep product listings and stock availability up to date; however, all items are subject to availability and may be changed or discontinued without notice.


 

 

SECTION 4 – PAYMENT & BILLING

 

All prices are listed in U.S. dollars and are subject to change without notice.

 

We reserve the right to:

 

Refuse any order

 

Limit quantities per household or order

 

Cancel orders suspected to be fraudulent or unauthorized


 

If your order is canceled, we will issue a refund to your original payment method.


 

 

SECTION 5 – SHIPPING & DELIVERY

 

We currently ship select non-perishable and perishable items within the United States. Shipping timelines are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, or events beyond our control.

 

Risk of loss transfers to you once the order is delivered to the carrier. For perishable shipments, you must be available to receive and properly store the order upon delivery.


 

 

SECTION 6 – RETURNS & REFUNDS

 

All sales are final. We do not accept returns or exchanges on any products—perishable or non-perishable—except where required by law.

 

If your order arrives damaged due to our error, please contact us within 48 hours of delivery with photos of the damage so we can review and determine an appropriate resolution.


 

 

SECTION 7 – ALLERGEN & LIABILITY WAIVER

 

By purchasing or consuming our products, you acknowledge that you have been informed of potential allergens and agree to release us from any liability relating to allergic reactions, illness, or injury.

 

We are not responsible for damages, losses, or injuries resulting from misuse, improper storage, or handling of products.


 

 

SECTION 8 – FARM TRANSPARENCY & LOCAL SOURCING STATEMENT

 

We take pride in sourcing many of our products directly from our own farm and from local Missouri producers whenever possible. While we strive for transparency regarding sourcing, seasonal changes and availability may require substitutions or changes without notice. Product descriptions and labeling will reflect the most accurate and current information available at the time of sale.

 

This commitment to local and farm-fresh products does not constitute a warranty or guarantee of availability, and it does not waive any disclaimers or limitations of liability stated in these Terms.


 

 

SECTION 9 – INTELLECTUAL PROPERTY

 

All branding, logos, product names, photography, and website content are the intellectual property of Cooper’s Coffee, Eatery & Market and may not be reproduced or used without our written permission.


 

 

SECTION 10 – LIMITATION OF LIABILITY

 

To the fullest extent permitted by law, Cooper’s Coffee, Eatery & Market shall not be liable for any damages—direct, indirect, incidental, punitive, or consequential—arising from your use of our products or services, whether purchased in-store or online.
